New Requirement for SCOTUS Nominees
There is a new requirement for SCOTUS nominees that has arisen in the last 24 hours among conservative pundits that a nominee must be an "intellectual heavyweight." Merely voting the right way 100% of the time is apparently not enough.
I think this is dangerous. Intellectualism is not always wise. In fact, Intellectualism left unchecked by common sense can lead one directly into marxism. Maybe we need some refreshing common sense on the court

Churchill supposedly said to Atlee "You had to choose between war and dishonor. You chose dishonor, and now you will have war."
My point? We can choose between an intellectual heavyweight or someone who votes the right way. But a lightweight has less of an ability to withstand the pull of the sophisticates to the left. In the end, we may have neither a heavyweight nor the right votes.

Yes, I have been hearing this argument, and I disagree. I think an intellectual heavyweight is more apt to rationalize himself or herself into a leftist than someone who is more grounded in a common sense view of the law.
However, I do agree with the pundits who argue that the Miers nomination is a blow for conservative speech. Bush should be appointing those who speak out who say they are pro life etc... rather than avoiding it. Conservatives should be rewarded for speaking out, not shunned.
